Court interdiction in France of a Community design
On January 17, 2007, the Paris Court of Appeal upheld a decision stating that the Civil Court was empowered to place a provisory interdiction on a Community design. The judge further indicated that there was no need for the owner of the earlier design to justify its use on the French territory in order to obtain an interdiction from the Court against a later Community design.
We agree with this solution, the provisory interdiction by the Court put a stop to an obviously illicit situation without further delay and without going into an analysis of the file which belongs to judge handling the grounds of the matter.
