PAM / PAM PLUVIAL
On March 22, 2007, the European Court of First Instance ruled that the marks and PAM PLUVIAL were similar. The comparison was focused only on PAM. The word PLUVIAL was regarded as accessory because it indicated in Spanish the products designated. The Court applied the PAM PAM vs./ PAM-PIM™s BABY SHOP approach. But the structure of the marks in this case was radically different. This new decision is very strict, mostly in that PLUVIAL can not be completely avoided.
