Similarity between TARKETT and tarkett-commercial.eu
Our firm filed a Complaint before the Czech Arbitration Center against the domain name tarkett-commercial.eu, for infringement of our client’s prior trademark rights on TARKETT. The decision, issued on May 9, 2007, was among the first ones to be ruled in favour of the complainant. The domain name in question was ordered to be transferred based on the facts that:
– The domain name and the TARKETT trademark were similar ;
– The respondent had no legitimate interest in the domain name;
– The respondent’s web site was a search engine dedicated to the Complainant’s field of activity (flooring solutions) and was consequently registered and used in bad faith. Its sole purpose was to attract internet users for commercial gain to its website.
