On March 14, 2007 The Paris First Degree Court has decided to pronounce the nullity of the trademark BOSS OF SCANDALZ STRATEGYZ filed by the famous French rapper Joey Starr.
This decision is not only based on an appreciation in abstracto of the similarity between this mark and the mark BOSS /HUGO BOSS of the company Hugo BOSS.
Indeed, the judges took into account the exploitation of the mark by the singer under the acronym B.O.S.S. and especially his bad reputation to consider the existence of a damage carried to notorious mark BOSS/HUGO BOSS. The question does not arise any more of knowing who is the boss.
