The Court of Justice of the European Communities (CJCE) ruled that the distribution of a signal by television means in an hotel room to the clients must be regarded as a public communication falling within the European copyright provisions. The private character of the hotel rooms has not been regarded as a pointless consideration.
This decision is in accordance with the long established case-law in France on the question.
