On October 2nd, 2007, the WIPO Arbitration and Mediation Center cancelled the domain name wwwactivia.fr (with a missing “.”) which redirected to a website with no similar activity to that of the plaintiff GERVAIS DANONE. The evident reputation of the marks ACTIVIA enabled to consider the domain name as reserved for the sole purpose of attracting consumers seeking for the website of the plaintiff. Fortunately, trademark reputation also works efficiently in a domain name complaint and thus enables to enjoy a larger scope of protection.
