Middle letters and imitation

On January 9, 2008 the French Trademarks Office ruled positively our opposition and admitted a likelihood of confusion between TRILEPTAL and TRIPLIXAL.The Opposition Division analyzed the resemblance due to the 7 letters in common, same sequence TRI/L/AL same rhythm and close sonorities to conclude that TRIPLIXAL constitutes the imitation of TRILEPTAL.
The difference between middle letters  does not affect the overall likelihood under French practice. This is not different when it comes to pharmaceuticals and the solution of the Office must be approved.
