An Affidavit of first use has to be filed for all the trademarks registered in Puerto Rico on an Intent-to-Use basis within 5 years from their registration date. An Affidavit of Use form duly notarized and apostilled has to be submitted along with 5 original specimens showing use of the mark in commerce. Failure to do so will result in the cancellation of such trademarks by the Puerto Rican Office.
