Domain names as earlier rights in complaints

On March 25, 2008, the WIPO Arbitration Center ruled that the registration of a domain name contrary to a loyal trade behavior is likely to infringe a third party’s rights. A complaint against the domain name was indeed filed on the basis of domain name. The sole registration of a domain name against the complainant’s rights was considered as sufficient for ordering the transfer. Needless to say that domain names shall now be integrated in WIPO complaints!
