New steps for past commented decisions

On July 17, 2008 the ECJ confirmed the fir shapes case (see IP TALK 4): the marks intellectually coincided in their ideas through an amusing variant. The Court further added that word elements of mix trademarks are not systematically regarded as dominant.
On June 26, 2008, the European Court of First Instance also confirmed the dissimilarity of POLAR and POLARIS (see IP TALK 5). The number and difference of syllables was all the more significant that consumers had greater degree of care for the products involved.
