Fraudulent Love

An interesting recent decision of the Paris Court of appeal stated on the issue of fraudulent applications. CLARINS owner, of the mark PAR AMOUR, successfully opposed it to the registration of the mark TOUT L’AMOUR of DIOR. DIOR however filed another trademark for TOUT L’AMOUR DE DIOR, hoping that the adjunction of their notorious company name could limit the likelihood of confusion. The Court considered that the second filing was fraudulent as its only purpose was to overcome prior opposition decision.
