On September 10, 2008, the European Court of First Instance ruled that “pharmaceuticals” were similar to “insecticides for killing dust mites”. For the Court, these products shared the same purpose, namely preventing or treating a respiratory illness.
Pharmaceuticals would be even more effective in solving respiratory problems thanks to insecticide effects on dust mites. Even if the solution is linked to the very high proximity of the signs, this remains a similarity case to be considered in IP strategies.
