On February 4, 2009, the Paris Court of First Instance ruled trademark infringement against an advertiser who had reserved a third party trademark as keyword on Google’s AdWords system.

For the judge, the public would believe – when seeing the link – that all the products offered had the same origin. The Court granted 15,000 € as damages to the plaintiffs and another 15,000 € for supporting their costs. Considering the uncertainty as to the grounds for suing GOOGLE, suing advertisers may truly constitute a suitable option.
