Since a few years, owners of French trademarks were uncertain regarding the extent of protection of their rights.

As a matter of fact, since 2004, there was a gap in the law regarding French Polynesia, which was excluded of the field of protection provided in articles L.811-1 and following of the French Intellectual Property Code.

A law was voted on 6th May 2013, recognizing French trademarks on the Polynesian territory, under the condition that a formality is fulfilled and a tax paid.

The decree specifying how the law should be enforced should be signed on September next. French trademarks registered between the years 2004 and 2013 will at least be recognized on the Polynesian territory.
