RHUDEX dissimilar to FLUDEX

On March 16, 2009, the Fourth Board of Appeal upheld that the audible and visual differences of “FL” and “RU” clearly overshadowed the shared final letters and sound “UDEX”.

The marks being short in length, without any possibility for the public to divide them in parts, the public would continue to make the distinction between them. We find that this approach is rather strict. In our opinion, the “UDEX” part takes visual and oral precedence over the prefixes, leaving the prefixes without a striking impact.
